Last updated: 9 October 2026
We take the protection of your personal data seriously. This policy explains which personal data SAMAR Yachts S.L. collects when you contact us, sign up for our newsletter, visit us at a boat show or on board, book a sea trial or a charter, or otherwise interact with us, and what rights you have. It is based on the EU General Data Protection Regulation (GDPR), the Spanish Organic Law 3/2018 on Data Protection and Digital Rights (LOPDGDD) and the Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI).

For any question about data protection or to exercise your rights, simply write to info@samaryachts.com.
2. Which data we process
- Contact details: first and last name, email address, phone number, company, postal address and country, where you provide them.
- Details of your request: your message, your interests (for example a private viewing, a sea trial, a purchase or a charter) and preferred dates.
- Communication data: our correspondence with you by email, phone or WhatsApp.
- Newsletter data: your consent, including the date, time and the form you used, your confirmation of the subscription (double opt-in), and whether you open our emails and click on links in them.
- Contract data: where you buy a yacht or book a charter, the data needed to prepare and fulfil the contract, including billing details.
- Technical data: when you visit our web pages, technical information such as IP address, browser type and the pages visited (see section 9).
3. Why we process your data and on which legal basis
Answering your enquiries and arranging visits, sea trials and charters
We use your data to answer your questions, send you information you have asked for (such as a brochure), and arrange viewings, sea trials or charters. Legal basis: the steps you ask us to take before entering into a contract (Art. 6(1)(b) GDPR) and our legitimate interest in replying to enquiries (Art. 6(1)(f) GDPR).
Newsletter and marketing emails
We only send you our newsletter (news, invitations and updates about SAMAR) if you have given your express consent (Art. 6(1)(a) GDPR, Art. 21 LSSI). After signing up, you receive an email asking you to confirm your subscription (double opt-in); you are only subscribed once you have confirmed. To understand which topics interest our readers, we measure whether our emails are opened and which links are clicked; this measurement is part of the newsletter you consent to. You can withdraw your consent at any time via the unsubscribe link in every email or by writing to us. Withdrawal does not affect the lawfulness of processing before it.
Contracts and accounting
If you buy a yacht or book a charter, we process your data to fulfil the contract (Art. 6(1)(b) GDPR) and to meet our legal obligations, for example under tax and commercial law (Art. 6(1)(c) GDPR).
Boat shows and events
If you leave your details at a boat show or event, we use them to follow up on your visit as described above. We only add you to our newsletter if you have given your consent.
Security and legal claims
Where necessary, we process data to protect our IT systems and to establish, exercise or defend legal claims (Art. 6(1)(f) GDPR).
4. Who receives your data
We do not sell your data. We only share it with service providers that help us run our business and that process it on our behalf under a data processing agreement, or where we are legally required to do so:
- HubSpot (HubSpot Ireland Ltd. and HubSpot, Inc.) for our customer database, web forms, landing pages and email newsletters. Our HubSpot account is hosted in HubSpot’s European data centre.
- WhatsApp Business (WhatsApp Ireland Ltd. / Meta Platforms Ireland Ltd.) if you contact us via WhatsApp or ask us to contact you there.
- Website hosting and IT service providers that host and maintain our websites and systems.
- Analytics and advertising services such as Google Analytics (Google Ireland Ltd.) or the Meta Pixel (Meta Platforms Ireland Ltd.), only if we use them and only with your consent (see section 9).
- Advisers and authorities: tax advisers, accountants, lawyers, banks and public authorities where this is necessary or legally required.
5. Transfers outside the European Economic Area
Some of our service providers are part of groups based in the United States, so your data may be accessed from there. In such cases we rely on the EU–US Data Privacy Framework, where the recipient is certified, or on the European Commission’s Standard Contractual Clauses, which oblige the recipient to protect your data to EU standards.
6. How long we keep your data
- Newsletter: until you unsubscribe. We keep a record of your consent and its withdrawal for as long as we may need to prove it.
- Enquiries: for as long as necessary to deal with your request and follow up, and in general no longer than 24 months after our last contact, unless a business relationship develops.
- Contracts and invoices: for the periods required by law, generally six years under Spanish commercial law and the tax limitation periods.
After that, we delete your data or keep it blocked only for as long as legal claims may arise.
7. Your rights
You have the right to:
- access the personal data we hold about you;
- have inaccurate data corrected;
- have your data erased;
- restrict processing;
- receive your data in a portable format;
- object to processing based on our legitimate interests, and at any time to direct marketing;
- withdraw your consent at any time with effect for the future.
To exercise these rights, write to info@samaryachts.com. We may ask you to confirm your identity. You also have the right to lodge a complaint with a supervisory authority, in Spain the Agencia Española de Protección de Datos (AEPD), www.aepd.es.
8. Do you have to provide your data?
Providing your data is voluntary. Without an email address, however, we cannot send you the newsletter, and without your contact details we cannot reply to your enquiry. We do not use automated decision-making or profiling with legal or similarly significant effects.
9. Cookies and similar technologies
Our web pages use technically necessary cookies so that pages and forms work correctly. Cookies for analytics or advertising, for example Google Analytics or the Meta Pixel, are only set if we use such services and you have given your consent through our cookie banner (Art. 22(2) LSSI, Art. 6(1)(a) GDPR). You can change or withdraw your consent at any time via the cookie settings or your browser settings.
10. Changes to this policy
We may update this policy when our services or legal requirements change. The current version is always available on this page.
